Alternative Dispute Resolution, or ADR, refers to processes that help parties resolve disputes without a judge, and without a trial. An alternative to court litigation, typical processes of ADR include Mediation and Collaborative Family Law

ADR allows for creative problem-solving techniques so that one party isn't walking away winning or losing. Since both parties take important roles in resolving a dispute, everyone is able to walk away without giving up what is important to them.

The Law Offices of Heather D. Harp, P.C. offers these methods of ADR that can potentially save money and speed up settlement. Get in touch to learn more about how we can help to reach your resolution.

COLLABORATIVE FAMILY LAW

COLLABORATIVE FAMILY LAW IS A WAY FOR A DIVORCING COUPLE  TO END THEIR MARRIAGE RESPECTFULLY. AS THIS PROCESS IS ANOTHER WAY OF AVOIDING COURTROOM LITIGATION, BOTH SPOUSES ARE ACCOMPANIED BY THEIR LAWYERS WHOM ALL WORK TOGETHER TO IDENTIFY AND ADDRESS ISSUES THAT NEED RESOLVE BEFORE DIVORCE. OTHER PROFESSIONALS CAN BE BROUGHT IN TO AID IN RESOLUTION LIKE FINANCIAL PLANNERS AND MENTAL HEALTH PROFESSIONALS.

IF ONE INDIVIDUAL DECIDES TO GO TO COURT, THE COLLABORATIVE PROCESS ENDS, NEW LAWYERS ARE INVOLVED, AND THE CASE MOVES TO LITIGATION. THIS ACTS AS MOTIVATION FOR EVERYONE INVOLVED TO REACH A MUTUALLY AGREEABLE RESOLUTION FOR THE BENEFIT OF THEMSELVES AND OF THEIR FAMILIES

MEDIATION SERVICES

MEDIATION IS A VOLUNTARY, ALTERNATE DISPUTE RESOLUTION WHERE A NEUTRAL THIRD PARTY CALLED A "MEDIATOR" GETS INVOLVED TO HELP PARTIES REACH A MUTUALLY AGREED SETTLEMENT. AS THE MEDIATOR DOESN'T DECIDE THE OUTCOME, THEY REACH RESOLVE BY FACILITATING OPEN COMMUNICATION, ALLOWING RESOLUTIONS TO BE REACHED AND CONFLICTS TO BE SETTLED.

MEDIATION CAN BE USED FOR SOLVING DISPUTES AMONG FAMILY, BUSINESS PARTNERS, OR NEIGHBORS - IT'S AN IDEAL PROCESS FOR THOSE SEEKING TO PRESERVE PERSONAL  AND BUSINESS RELATIONSHIPS. MEDIATION IS NOT USED WHEN ONE PARTY HAS A SIGNIFICANT ADVANTAGE IN POWER OVER THE OTHER, LIKE IN INSTANCES OF DOMESTIC VIOLENCE.
